Terms of Service — RiseUp: Habit & Streak Tracker

These Terms of Service (“Terms”) are an agreement between you and Soft Learn Hub (“we”, “us”, “our”), the developer of RiseUp — Habit & Streak Tracker (“RiseUp”, “the app”). Please read them before using the app.
1. Acceptance
By downloading, installing or using RiseUp, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.
Your use of the app is also subject to the Google Play Terms of Service and any agreement between you and Google. Where Google’s terms conflict with ours in relation to distribution and payment, Google’s terms govern that subject matter.
2. Eligibility
You must be at least 16 years old, or the age of digital consent in your country if that is higher, to use RiseUp. By using the app you confirm that you meet this requirement and that you are legally able to enter into these Terms.
3. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use one copy of RiseUp on devices you own or control, for your own personal, non-commercial use.
You may not:
- copy, sell, rent, sublicense or redistribute the app;
- reverse engineer, decompile or disassemble it, except where that right cannot be restricted by law;
- remove or alter any proprietary notices;
- modify the app or create derivative works from it;
- use automated means to interact with the app’s advertising, or otherwise attempt to generate invalid ad impressions, clicks or rewards;
- use the app to break any law or to infringe anyone’s rights.
We may revoke this licence if you breach these Terms.
4. RiseUp is not medical advice (important)
RiseUp is a self-tracking and motivational tool. It is not a medical device, not a treatment, not therapy, and not a substitute for professional care.
- Nothing in the app constitutes medical, psychological, psychiatric or clinical advice, diagnosis or treatment.
- No doctor–patient, therapist–client or other professional relationship is created by using it.
- Motivational quotes, breathing exercises, statistics and “insights” are general wellbeing content generated from your own entries. They are not personalised clinical guidance and may not be accurate or appropriate for your situation.
- You should not delay, avoid or discontinue professional care because of anything in the app.
If you are struggling with a compulsion, an addiction, withdrawal symptoms, or your mental health, please speak to a qualified healthcare professional. If you are in crisis or thinking about harming yourself, contact your local emergency services or a crisis helpline in your country immediately. The app is not equipped to help in an emergency.
You use RiseUp at your own discretion and are solely responsible for decisions you make about your health and behaviour.
5. Your data and your backups
- Your entries are stored on your device. You are responsible for your own data.
- Uninstalling the app, clearing its storage, resetting your device, losing your device, or a device fault will permanently delete your data, and it cannot be recovered by us.
- If you enable backup, backups are stored in your own Google Drive and are subject to your agreement with Google. We do not hold copies.
- If you set a backup passphrase and forget it, your backup cannot be decrypted by anyone, including us. There is no recovery mechanism, and this is by design.
- We are not liable for lost, corrupted, incomplete or unrecoverable data.
We strongly recommend enabling backup and recording your passphrase somewhere safe.
6. Google Drive integration
The backup feature is optional. If you use it, you authorise RiseUp to create, read, update and delete only the files it creates in your Google Drive account, using the drive.file permission scope. RiseUp cannot access any other file in your Drive.
Your use of Google Drive is governed by Google’s terms and privacy policy. You may revoke the app’s access at any time from Settings within RiseUp or from your Google Account permissions page. Revoking access stops backups; it does not delete backups already stored in your Drive.
7. Advertising and optional unlocks
RiseUp is provided free of charge and is funded by advertising served through Google AdMob.
- Ads appear on secondary screens and in optional rewarded videos. Ads are never shown on the streak counter or on the SOS / urge screens.
- Rewarded content is optional. You may choose to watch an advertisement to unlock cosmetic extras such as themes, sound packs or additional quote packs. You are never required to watch an advertisement to use any core feature of the app.
- Unlocked items have no monetary value, are not property, cannot be transferred, sold or exchanged, and are not refundable. They may be lost if you uninstall the app without a backup.
- We are not responsible for the content of third-party advertisements or for any product or service they promote. Any dealings you have with an advertiser are solely between you and them.
- Attempting to manipulate the ad or reward system may result in loss of unlocks and termination of your licence.
If a paid version or in-app purchase is offered in future, purchases are processed by Google Play, and refunds are governed by Google Play’s refund policy.
8. Acceptable use
You agree not to use RiseUp to store or transmit unlawful content, to interfere with the app’s operation or security, to attempt unauthorised access to any system, or to help anyone else do these things.
9. Intellectual property
RiseUp, its name, logo, design, source code, artwork, badge designs and bundled content are owned by Soft Learn Hub or its licensors and are protected by intellectual property law. These Terms grant you a licence to use the app, not any ownership of it.
Your content belongs to you. Journal entries, notes and logs you create are yours. Because we never receive them, we claim no licence or right over them of any kind.
10. Availability, updates and changes
We may update, modify, suspend or discontinue the app or any of its features at any time, with or without notice. We may release updates that you must install to keep using the app. We do not guarantee uninterrupted or error-free operation, and features that rely on third parties (advertising, Google Drive) may be unavailable at times for reasons outside our control.
11. Termination
You may stop using RiseUp at any time by uninstalling it. We may suspend or terminate your licence if you breach these Terms. Sections 4, 5, 9, 12, 13, 14 and 15 survive termination.
12. Disclaimer of warranties
To the fullest extent permitted by law, RiseUp is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the app will meet your requirements, that it will be uninterrupted, secure or error-free, that its statistics or insights are accurate, or that any result will be achieved through its use.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing in these Terms limits your non-excludable rights as a consumer under the law of your country.
13. Limitation of liability
To the fullest extent permitted by law, Soft Learn Hub and its owners and contributors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, revenue, goodwill or opportunity, arising out of or relating to your use of or inability to use RiseUp — even if we have been advised of the possibility of such damages.
Our total aggregate liability arising out of or relating to the app and these Terms will not exceed the greater of (a) the total amount you have paid us for the app in the twelve months preceding the claim, or (b) USD 10.
Nothing here excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud.
14. Indemnity
You agree to indemnify and hold harmless Soft Learn Hub from any claim, demand, loss or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the app, or your violation of any law or third-party right.
15. Governing law and disputes
These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law rules. The courts of Islamabad, Pakistan have exclusive jurisdiction over any dispute, except that if you are a consumer resident elsewhere, you may also bring proceedings in the courts of your country of residence, and you retain the benefit of any mandatory consumer protection law that applies there.
16. General
- Entire agreement. These Terms and the Privacy Policy are the whole agreement between us regarding the app.
- Severability. If any provision is held unenforceable, the rest remains in force.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition or sale of assets.
17. Changes to these Terms
We may revise these Terms from time to time. The current version is always posted at this URL with a “Last updated” date. Material changes will be notified in the app before taking effect. Continued use after a change means you accept the revised Terms.
